Hyundai Motor Privacy Notice for Online Employment Applications

 

In this Privacy Notice we inform you about the collection and processing of your personal data in connection with your application of employment with us and your use of our careers websites (https://www.jobs.hyundai-europe.com) and the online application system  (https://career5.successfactors.eu/careers?company=hyundaieurope)  (collectively referred to as “Recruiting Platform”)  and your rights as a data subject.

 

We take your privacy very seriously and will process your personal data only in accordance with applicable data protection and privacy law.

 

  1. Who is responsible for processing my data and how can I contact the controller?

 

Hyundai Motor Europe GmbH, with registered office in Kaiserleipromenade 5, 63067 Offenbach, Germany (“HME” or “Company” or “we” or “us” or “our”) is responsible for the processing of your personal data as explained in this Privacy Notice.

 

Please note that depending on the vacancy and the location you apply for, the relevant Company affiliate acts as an independent data controller. This means that each Company affiliate is responsible for the processing of your personal data, and HME, that provides the Recruiting Platform, acts as a data processor of each Company affiliate. 2. What categories of personal data are processed?

 

The online application system serves the purpose of enabling you to electronically enter and submit employment application data to us on a voluntary basis. To apply you need to register for an applicant account. After registering you receive a confirmation email. Then you are requested to enter further data and finally you can apply for a job. During the course of your use of our Recruiting Platform, we collect and otherwise process the following personal data:

  • Profile information such as first name, last name, email, phone, address, city, country, and other information such as fields of interest, language skills, your willingness to relocate and preferred location  etc.;
  • Application documents such as CV, cover letter, academic certifications, professional qualifications, application photo, etc.  
  • Work experience related information, such as title, current and previous employers, start and end date of your employment, country, etc.
  • Education related information, such as school, degree, subject, start and end data, etc.;
  • Information provided by you during the interviews, such as information in connection with your education background, working experience, your current tasks, past achievements, salary expectations, and other information you choose to share with us during your interview.
  • Information generated by us, such as assessments on you by the interviewers, details on offer letter, and the final score you reached to online assessments (if applicable) in terms of work style, work preferences, top talents, etc.
  • Account details, such as user name and password.
  • Technical information about your use of our websites. After you create a profile, technical information is automatically transferred to us by your web browser upon accessing our webpages. Such information may include applicant ID, visits, subscriptions, applications started and completed, status date, etc.

 

Please note that in acknowledging an application we are not verifying the content, accepting the application or making any offer of employment or engagement. You are responsible for ensuring that the personal data provided is true and correct.

  • Special categories of personal data

 

The following special categories of personal data might be processed to the extent that they are provided by you in your application documents or otherwise revealed by you during your communication with us:

  • Marital status information (marriage, civil partnership, children), from which sexual orientation might be inferred.
  • Health data, such as severe disabilities, vaccination, or other information you choose to disclose in order for us to make special arrangements suitable for your needs.
  • Religious beliefs to the extent needed for church tax purposes.

 

3. For what purposes and on what legal basis is my data processed?

We process your personal data in connection with your use of our Recruiting Platform. The purpose of our processing is

  • To allow your registration to our careers website;
  • To consider your application;
  • To assess your suitability for the applied position and announce our final decision to you;
  • If applicable, to send you an offer or prepare the necessary employment agreement or other documents needed for onboarding;

 

The legal basis for such processing is Art. 6 para. 1 lit b GDPR or respective national legislation (for example for Germany Section 26 para.1 s. 1 Bundesdatenschutzgesetz or BDSG).

 

We are based on our legitimate interest Art. 6 para. 1 lit f GDPR when we process part of your personal data in order:

  • To provide a safe online environment, operate our websites and ensure they are working properly;
  • To contact you and reply any questions you might submit to us;
  • For statistical purposes and for improvement of our internal processes.

 

We rely on your consent Art. 6 para. 1 lit a, to send you news about career opportunities with us. You have the right to withdraw your consent any time through deselecting the relevant tick box in your profile section “Search Options and Privacy”. Such a withdrawal will not affect the lawfulness of the processing prior to your consent withdrawal. Your choice to provide or withdraw your consent shall not have any impact on your applications.   

If applicable, the processing of special categories of personal data is based on Art. 9 para. 2 lit b (or for Germany Section 26 (3) BDSG) when we need to exercise our rights or comply with legal obligations arising from employment law.  

 

4.Do you use cookies?

 

Cookies are text files which are stored on your computer. After you have finished your session and closed your browser many of the text files are deleted (“session cookies”). So-called “persistent cookies” might also be stored and these allow us to recognise you during your next visit on our websites. You can prevent cookies being saved on your computer by changing your browser settings. This may result in some functions used by our website being restricted.

 5. With whom is my data shared?

 

Any access to your personal data by us is restricted to those individuals that have a need to know in order to fulfill their job responsibilities.

 

Your personal data may be transferred for the respective purposes to the recipients and categories of recipients listed below and processed by those recipients for the respective purposes:

 

  • Other Hyundai group companies: Depending on the privacy settings that you select, your profile might be visible to other authorized employees of other company recruiters and/or authorized assigned third parties (hereafter referred to as ‘Representatives’) for the purposes of processing your application. You may choose to make your information visible to representatives managing vacancies only to which you apply, to representatives from your country of residence, or to representatives from all locations globally.  
  • Data processors – We transmit your personal data to certain third parties, that process your data on behalf of us under appropriate instructions as necessary for the respective processing purposes. The data processors will be subject to contractual obligations to implement appropriate technical and organizational security measures to safeguard the personal data, and to process your personal data only as instructed. We are currently working with the following processors:
    • SAP Deutschland SE & Co. KG, Hasso-Plattner-Ring 7, 69190 Walldorf, Germany which provides us with the Recruiting Platform;  
    • Hyundai Autoever Europe GmbH, Kaiserleistrasse 8A, 63067 Offenbach am Main, Germany, which is our service provider for technical support;
    • Plum.io Inc, 60 Bathurst Drive, Unit 9, Waterloo, ON N2V 2A9, Canada (“Plum.io”), which is the provider of the online assessment system. More specifically, we will share your full name and email to this provider to initiate the online assessment and finally we will access the final score of the assessment. We do not have access to the specific answers you gave to the questions during the assessment. Please note that Plum.io might collect other personal data for their own purposes and they do it as an independent controller and not in their role of processing personal data on our behalf. Plum.io gives you also the possibility to choose with which entities you want to share your assessment results. For more information on how Plum.io Inc. collects and processes your personal data and how to exercise your personal data, please refer to their privacy policy.   
  • Governmental authorities, courts, external advisors, and similar third parties that are public bodies as required or permitted by applicable law.

 

 6. Is my data transferred abroad?

 

Some of the recipients of your personal data will be located or may have relevant operations outside of your country and the EU/EEA, where the data protection laws may provide a different level of protection compared to the laws in your jurisdiction and with regard to which an adequacy decision by the European Commission does not exist (e.g. sub-processors of our data processor Plum.io).

 

With regard to data transfers to such recipients outside of the EU/EEA we provide appropriate safeguards, in particular, by choosing partners who are based in a jurisdiction with an adequacy decision or by way of entering into data transfer agreements which include standard clauses adopted by the European Commission or taking other measures to provide an adequate level of data protection. A copy of the respective measure we have taken is available via HME.

 

 7. How long will my data be stored?

 

We and/or our service providers store your personal data to the extent necessary for the performance of our obligations and for the time necessary for the purposes for which we have collected your personal data, in accordance with applicable data protection laws. When we no longer need to process your personal data for such purposes, we will erase it from our systems and/or records and/or take steps to properly anonymize it so that you can no longer be identified from the data (unless we need to keep your information to comply with legal or regulatory obligations to which we are subject). 

 

  • Your personal profile is stored for a period of six (6) months following your last active day. You will receive email notification that the six (6) month period is due to expire and you will then have the opportunity to further extend or delete your profile. However, you might choose to delete your personal profile even before the above mentioned due period. Please refer to “Right to erasure (Right to be forgotten)” for more details.

 

Please note that certain Company affiliates might store your personal data for a longer period of time, in accordance with the local legal requirements. For example, your personal data might be stored for a period of two (2) years if you apply for a vacancy in Italy. Please contact the Company affiliate you are applying to if you want to understand more on the exact retention period of your personal data. 8. What rights do I have and how can I exercise them?

 

If you have given your consent to the processing of your personal data, you can withdraw your consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to your consent withdrawal.

 

Pursuant to applicable data protection law, you have the following rights with respect to the processing of your personal data. Please note that these rights might be limited under the applicable national data protection law.

 

  • Right of access: You have the right to obtain from us confirmation as to whether or not personal data concerning you is processed, and, where that is the case, to request access to your personal data. This information includes – inter alia – the purposes of the processing, the categories of your personal data concerned, and the recipients or categories of recipients to whom your personal data have been or will be disclosed. However, this is not an absolute right and the interests of other individuals may restrict your right of access.

 

You also have the right to obtain a copy of the personal data about you undergoing processing. For any further copies you might request, we may charge a reasonable fee based on administrative costs.

 

You can also access the data you have filled in and check the status of your application after you log in to your personal profile on the online application system.

 

  • Right to rectification: You have the right to obtain from us the rectification of inaccurate personal data concerning you. Depending on the purposes of the processing, you have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

 

You can also log in to your personal profile and rectify any inaccurate data.

 

  • Right to erasure ("right to be forgotten"): Under certain circumstances, you have the right to obtain from us the erasure of your personal data and we may be obliged to erase your personal data.

 

You can also choose to delete your personal profile after you log in to the system through the following path: Options – Settings – Delete Profile.

 

  • Right to restriction of processing: Under certain circumstances, you have the right to obtain from us restriction of processing your personal data. In this case, the respective data will be marked and may only be processed by us for certain purposes.

 

  • Right to data portability: Under certain circumstances, you have the right to receive your personal data, which you have provided to us, in a structured, commonly used and machine-readable format and you have the right, without hindrance from us, to transmit those data or have it transmitted directly by us to another entity.

 

  • Right to object: Under certain circumstances, you have the right to object, on grounds relating to your particular situation, at any time to processing your personal data, and we can be required to no longer process your personal data. If your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data for such marketing, which includes profiling to the extent that it is related to such direct marketing. In this case your personal data will no longer be processed for such purposes by us.

 

  • Right to lodge complaint: You also have the right to lodge a complaint with the competent data protection supervisory authority, for example in your country of residence.

Am I obliged to provide my data?

 

The provision of personal data is no statutory or contractual requirement. You are not obliged to provide personal data. However, the provision of certain personal data (for example first name, last name, email address, CV, password for your account at our website, residence, telephone number, your postal address, etc.) is necessary to undergo the registration and the recruitment process. Required data categories are marked with a red star (*) in the web-form. If you do not provide these data, your application cannot be submitted and not be processed.
